Upon agreeing to NuLeaf Clinics Website Terms and Conditions, you recognise that scheduling an appointment through the website constitutes an agreement with the selected professional (referred to as the “Professional Adviser”) based on the Appointment Booking and Consent Terms (referred to as the “Booking Terms”). These Booking Terms incorporate the defined terms outlined in NuLeaf Clinics Website Terms and Conditions.
1.1 Failure to provide a valid and verifiable credit card will result in the inability to proceed with booking.
1.2 Booking on behalf of another individual is prohibited unless expressly approved by us in advance in writing.
2.1 By booking your appointment, you agree to pay the correct Fee for services provided by your chosen Professional Adviser.
2.2 The fee charged will correspond to the type of appointment scheduled, rather than the one selected. For instance, if you choose a ‘Follow-up’ appointment but you actually require a ‘New Appointment,’ you will be billed for the latter.
2.3 The Fee, or any portion thereof, is non-refundable, even after your reading has occurred, except as per the guidelines outlined in the Cancellation Policy.
2.4 The payment timing for the applicable Fee depends on the type of account you’ve signed up for with NuLeaf Clinics.
2.5 You are accountable for covering all expenses related to accessing any prescriptions and treatments as advised by your Professional Adviser, as well as any other incurred costs. It’s important to note that the Pharmaceutical Benefits Scheme (PBS) does not cover these expenses.
3.1 You consent to attend your appointment at the designated time and/or through the specified method communicated to you during the booking process. It is imperative to ensure accuracy and attentiveness to your appointment details. Incorrectly scheduled bookings will be treated as missed appointments, adhering to the guidelines outlined in the Cancellation Policy.
3.2 If requested, you consent to provide a copy of your photo identification to us and/or your Professional Adviser to verify your identity before or during any appointment.
4.1 All bookings shall be subject to the following further terms and conditions:
(a) Instructions on how to participate in an appointment, including any requests for additional information, will be sent to you via email. You are required to utilise these instructions to participate in your appointment;
(b) You recognise and agree to all the details specified in the Patient Consent Matters provided below;
(c) It is your responsibility to consider and adjust for any time zone differences;
(d) You are required to guarantee that you are in a secluded and noise-free room where you will not face interruptions for the entire duration of your appointment, ensuring that no distractions from any person or object occur during the session;
(e) All electronic devices, except for the one used for the reading session, must be powered off during your participation in the reading;
(f) All applications, software, and notifications on the device utilised for the appointment, apart from the designated communication software, must be deactivated or closed, including any recording devices or software.
(g) you must answer all questions truthfully and accurately;
(h) In the event that your appointment is scheduled to take place online, and your internet connection fails to consistently maintain a download speed of 15 megabits per second or higher and an upload speed of 2 megabits per second or higher throughout the reading session, you acknowledge and agree that your appointment may experience dropouts, static, or disconnections. Consequently, there is a higher likelihood of encountering cancellations or incomplete appointments as outlined in sub-clauses 4.1(j) and 4.1(k). It is important to clarify that you may still proceed with booking a reading even if your internet speeds do not meet the specified criteria, albeit at your own risk.
(i) You are required to be connected online or dialed in for your appointment at least 5 minutes before the scheduled appointment time;
(j) It is essential to have the most recent version of any communication software, internet browser, or phone line utilised for your appointment, ensuring that the software is fully operational. Please be aware that no time extensions or rescheduling of scheduled appointments will be provided in case of delays or disconnections due to connectivity issues; and
(k) In the event of poor or dropped visual and/or audio connection during any appointment, it is understood that a maximum of 3 attempts will be made to re-establish the connection. If the connection persists in dropping out or remains poor to the extent that it significantly impacts the appointment, it will be considered as cancelled by you in accordance with the Cancellation Policy. Consequently, you will not be eligible for a refund.
4.2 You commit to conducting yourself respectfully and with integrity throughout each appointment. You agree to cooperate fully and refrain from intentionally misleading or providing false information to us or your Professional Adviser.
5.1 Despite the Cancellation Policy, we will make reasonable efforts to accommodate any requested changes to appointment times received before 48 hours prior to your appointment. However, we reserve the right to consider any requested changes as cancellations in accordance with the Cancellation Policy.
5.2 You acknowledge that we may need to reschedule appointments with our professionals for various reasons, including but not limited to illness, acts of nature, and other unforeseen circumstances. You agree to engage in good-faith discussions regarding the rescheduling of any appointment due to our need to amend a booking for any reason.
6.1 Termination and cancellations of appointments are subject to the Cancellation Policy.
7.1 You acknowledge and consent to the following matters concerning your appointment with your Professional Adviser:
(a) There is a risk that any recommended treatment or product may not achieve the desired outcome, even when conducted with due professional care.
(b) Personal, health, and medical information disclosed during your appointment will be shared among various parties, including us, your Professional Adviser, and any dispensing pharmacy, in accordance with the Therapeutic Goods Act 1989.
(c) You have fully disclosed any previous health, psychiatric, and/or medical conditions and/or symptoms, including pregnancy or the intention of becoming pregnant, to your Professional Adviser.
(d) You have disclosed, or will disclose, to your Professional Adviser all medicines, treatments, and drugs (including alcohol and illicit/recreational drugs) currently in use or previously consumed.
(e) Follow-up consultations may be necessary and/or mandatory in certain circumstances.
(f) You may be considered for inclusion in experimental cannabis-based treatments and products programs/trials, which may be terminated or modified at any time.
7.2 If you are prescribed a cannabis-based product following any appointment booked via NuLeaf Clinics, you acknowledge and consent to the following matters:
(a) Many cannabis-based products are not registered under the Australian Register of Therapeutic Goods and are experimental.
(b) There could be unknown risks and side effects (both short-term and long-term) associated with the use of cannabis-based products, and you accept such risks.
(c) Only the dose/treatment/application recommended shall be used as directed by your Professional Adviser.
(d) Some prescribed treatments may cause various side effects, especially if not used as directed by a relevant professional adviser.
(e) Certain factors could significantly increase the risks of using prescribed products, such as a history of psychotic illness, cardiovascular disease, substance abuse, pregnancy, or breastfeeding.
(f) Any adverse effects of prescribed treatments must be reported to us.
(g) You will participate in a trial of alternative treatments and products.
(h) Due to the experimental nature of alternative treatments, attending certain further consultations with your Professional Adviser and reporting adverse effects of any treatments/products will be mandatory.
(i) The outcomes of treatments, side effects, and related information will become part of a research database used to study the use, benefits, risks, and effects of alternative treatments, products, and medicines, unless consent is withdrawn in a reasonable and timely manner.
(j) The prescribed product will not be shared with any third party.
(k) You must not operate vehicles or machinery (including heavy machinery) or engage in any dangerous, illegal, or reckless activities while affected by any treatment/product.
7.3 Health Summary – I consent to Greencare contacting my current General Practitioner (GP) to request a copy of my health summary, if I have not already provided this information.
(a) I consent to Greencare discussing my medical information with other practitioners within the Greencare network or with external healthcare providers as necessary to support my care and treatment.
7.4 I agree and understand that my prescription may be directed to a pharmacy with which my practitioner maintains communication with to ensure compliant and efficient processing. I also acknowledge that I have the right to choose my preferred pharmacy. To do so, I understand that I must inform my practitioner of my choice during my consultation. I further understand that any changes to my pharmacy preference outside of this time will require a new consultation to make any update.
8.1 You agree not to record, film, or otherwise capture any appointment under any circumstances.
8.2 If it is discovered that an appointment is being recorded, filmed, or otherwise captured, you grant us the right to confiscate the device and/or item capturing (or suspected of capturing) the appointment and to search for and delete and/or destroy the recording or other captured representation of the appointment without compensation to you. You also agree that your Professional Adviser may immediately terminate the appointment in such circumstances, and you shall not be entitled to a refund.
9.1 To the extent permitted by law, we and your Professional Adviser assume no responsibility (and shall not be liable) for any decisions or actions you take as a result of your appointment, and you release us and your Professional Adviser from any and all liability that may arise in connection with your participation in your appointment or treatment.
10.1 You and we agree that the matters discussed in your appointment are confidential and will be treated as such by you, us, and your Professional Adviser. You also agree to keep all other confidential matters relating to your appointment confidential. It is understood that any confidential information disclosed to you by us or your Professional Adviser may only be disclosed if required by law or for the purpose of seeking professional legal advice (where such advice is bound by confidentiality).
10.2 You agree not to make (or authorize) any comment or representation that may disparage, defame, or negatively affect us or your Professional Adviser (including any negative and/or misleading comments regarding the appointment).
10.3 Without limiting the foregoing, you agree not to make any false or misleading representations or otherwise make untruthful comments regarding your appointment.
